*Initiative 71 was a voter-approved ballot measure in Washington, D.C., that legalized the recreational use of cannabis. Approved by 64.87% of voters in 2014, it allows adults 21 and older to possess up to two ounces of marijuana, grow up to six plants, and gift up to one ounce to other adults, though sales remain banned. A unique aspect of Initiative 71 is the creation of a “gifting economy” for cannabis due to the ban on commercial sales.

*Initiative 81, formally known as the “Entheogenic Plant and Fungus Policy Act of 2020,” is a voter-approved ballot initiative in Washington, D.C. It was passed on November 3, 2020, with the support of 76% of voters and went into effect on March 16, 2021. The initiative directs law enforcement to make the non-commercial cultivation, distribution, possession, and use of entheogenic plants and fungi, such as psilocybin mushrooms and ayahuasca, among the lowest law enforcement priorities . This effectively decriminalizes the use of these substances in D.C., although it does not change their legal status.

THCa (tetrahydrocannabinolic acid) is a non-psychoactive cannabinoid present in raw cannabis flower. It does not produce intoxicating effects unless heated through smoking, vaping, or cooking, which converts it into delta-9 THC via decarboxylation. The legality of THCa flower may vary depending on state and local regulations. While hemp-derived products containing less than 0.3% delta-9 THC are federally legal, it is the responsibility of the purchaser to be aware of and comply with all applicable laws in their jurisdiction. Due to specific state regulations, THCa products are not available for shipment to the following states: Alabama, Alaska, Arkansas, California, Colorado, Hawaii, Idaho, Kansas, Louisiana, Oklahoma, Oregon, Rhode Island, Utah, and Vermont.
